If you own assets when you pass away that were in your sole name and did not name a beneficiary, then a Last Will and Testament is the document that states who you’d like to receive those assets. The Will also names a Personal Representative, and this is the person who will be given authority by Probate Court to pay any debts you’ve left behind and to then distribute the remaining assets as you’ve directed.
